Finance Ministry Notifies October 1 Implementation Date for Bankers' Books Evidence Act 2026
The Ministry of Finance announced on September 11, 2026, that the newly enacted Bankers' Books Evidence Act, 2026 will come into force starting October 1, 2026, following an official gazette notification issued on September 10. Having received Presidential assent on August 13, 2026, the updated legislation formally replaces the century-old Bankers' Books Evidence Act of 1891, modernising how financial records are presented and evaluated as legal evidence in Indian courts.
Under the new law, a technology-neutral approach has been adopted to keep pace with the rapid digital transformation of the financial sector. The legal definition of "bankers' books" has been expanded to explicitly recognize records maintained in physical, electronic, digital, virtual, and cloud-based formats, including data stored at backup and disaster recovery sites. Furthermore, the statute introduces a standardized two-track certification mechanism, permitting authentication through manual signatures or IT Act-compliant digital and electronic signatures, thereby ensuring electronic bank records cannot be denied admissibility solely because of their digital form.
To safeguard routine financial operations from unnecessary judicial disruptions, the Act outlines clearer procedures for summoning bank officers when a institution is not a direct party to legal proceedings, requiring courts to record a "special cause" in writing. The Central Government also holds authority to extend these evidentiary standards to non-banking financial sector entities. Overall, these reforms are expected to streamline litigation, lower legal compliance overheads for banks, and strengthen trust in India's digital financial framework.
