Karnataka Enacts Shops Amendment Act 2026 Barring Retention of Original Employee Documents
The Government of Karnataka has officially notified the Karnataka Shops and Commercial Establishments (Amendment) Act, 2026, introducing significant regulatory changes to labour compliance and workplace practices across the state. The legislation, which recently received the Governor's assent, aims to streamline administrative procedures for commercial establishments while enforcing stronger protections for workers' legal rights.
A key provision of the amended legislation is the strict prohibition on employers retaining original educational or identity documents of their employees. Under the new law, business owners and corporate entities are barred from confiscating original certificates during recruitment or employment, addressing a long-standing complaint among workers across various sectors. Additionally, the Act mandates the timely issuance of service certificates to departing employees and exempts certain categories of businesses from redundant duplicate registration processes.
The amendment has also revised compounding mechanisms and penalty provisions for non-compliance, introducing structured fines for statutory violations. Meanwhile, the statutory updates have drawn close scrutiny from employee unions, including the Karnataka State IT/ITeS Employees' Union (KITU), which raised concerns regarding procedural framing around night-shift safety provisions for women workers. Labour department officials clarified that occupational safety and health standards remain comprehensively protected under overarching labour framework regulations. The law reflects ongoing efforts by public administration to balance business compliance efficiency with workforce welfare.
